marlin court. the investigator was on duty, but they're not releasing any details. sfpd approached two agents, one of the agents tried to rob the woman fp the injuries are described as nonlife threatening. special investigators with the irs are armed. >> i'm absolutely sure they did not know they were dealing with an agent, otherwise i don't think they would have tried to rob the person. >> police say the second robber did run off, they later detained for questioning. notice of an appeal has been filed by the backers of proposition 8. their legal action comes one day after von walker overturned the ban on gay marriage. walker and his opinion said the voter approves initiative violated the constitution's guarantees of due process and equal protection. the judge suspended his ruling

ll/like ttern, current temperatures 10 to 15 degrees below average, only 67 in napa, 66 in livermore and 62 in san mateo, thedeol cst colst record since 1933. it's been about 30 plus years since the bay area has had a trend this cool. the jet stream is moving cooler air in the bay area, that's combining with fog which we're used to getting this time of year, helping to ramp things up, santa rosa in the top five coolest summers at this point. san jose ranking in the top ten, we'll continue to go down in the record books it looks like as we head throughout the next couple weeks with this trend that looks to be lasting, here's a look at today's expected highs from santa rosa down into san jose, we are once again about 15 degrees off the mark. let you know how cool it's going

to get for tomorrow coming up. >> san francisco people are beginning to wonder if they'll ever begin to see the sunshine. san jose has come up with a plan to save the jobs of those firefighters laid off last week, it's going to come at a price. the city and firefighter's union went back to the bargaining table but negotiations hit a stalemate when the city rejected a new offer from fire fighters. every city department needed to make cuts and the firefighters didn't make enough of them. reid wants the department to vote on an 8.9% cut in take home pay. the executive board will vote on that proposal next tuesday. teachers, police and firefighters may catch a break if a bill moving through congress is approved. a $26 billion jobs bill cleared the snatd today, but it still needs house approval. nancy pelosi will call lawmakers back into session next week to finish the bill, which would give states $10 billion for education programs, 16 billion to plug other holes in their

budget. the new report shows that $348 million in state funding has been cut from california's preschool program. california spends more than $3600 a year for each prekindergarten student. state, local and federal government s spend 11,000 per student from kindergarten through 11th grade. a new phone call home, a uc berkeley grad imprisoned in iran is being denied medical claire after she found a lump in her breast. she's not getting treatment for the lump or other medical issues. nora shord is asking the united nations to intervene to get her daughter some help. iranian officials jailed the 31-year-old more than a year ago. the three cal grads were hiking in northern iraq when they were seized. they were accused of illegally crossing into iran. a convention on cannibus.

the first ever in the south bay starts tomorrow at the san jose convention center, it's called hempcon. 15,000 people will walk-through the doors over the next three days. what exactly will they see? and what can't they do? that's going to be an interesting convention. >> reporter: it should be very interesting, 15,000 people is a lot of people. when you're expect that many people, the day before they arrive is busy. they've been busy setting up the booth here. the expectation is 100 plus vendors will show up. there's a booth over there called hemp ale, what will people see when they get here? they'll get information on medical marijuana, pot clubs. there's even a booth for a lawyer here. you can't smoke pot while you're here. the director of the event asked the city to set up a self-medication tent inside but the city said no.

any smoker, cigarette or otherwise can't take place closer to 25 feet from the direction. they asked san jose police to provide security, and the city turned them down as well. we have to ask if the folk s who run the convention had any reservations about booking the convention. >> in terms of us making a determination about the nature of the event, we try not to do that. >> reporter: if what they're doing is legal, then all they care about, will it bring in the visitors they say it will, will they rent hotel rooms and spend money in downtown san jose. they say they're on the lookout for growing businesses, and c i cannibus is one on the measure. two years ago, there wasn't a single pot club in the city, now there are more than 70.

cemented shut, it's more than 100 days but the well in the gulf is close to being permanently sealed. it's not the end of the crisis. jay gray has the latest from venice, louisiana. >> reporter: this afternoon, engineers finished pushing in cement to seal the well from the top. now there's a growing sense the flow of oil may be finally over. >> this is not the end but if will assure us there will be no chance of oil leaking into the environment. >> struggling fishermen meeting in alabama raise it a bit differently. >> the area to the west is dead. >> reporter: for many, the problems and frustration from almost three months of crude pouring into the gulf are still very much alive. >> i'm excited about the well being capped. but my neighbor who's fixing to lose his home and close his business, it don't mean a whole lot to him. >> there continue to be lingering questions about how much oil is still in the water. government scientists say 75% of the 207 million gallons from the

nbc bay area news. the united states supreme court has a new justice. >> sally is 6337. the nomination is confirmed. >> and with that, the senate confirmed elenakagan as the newest supreme court justice. her confirmation was assured when five republicans joined all but one democrat to vote yes, when kagan is sworn in on saturday, she'll join ruth bader ginsberg and sonya sotomayor who was president obama's first nominee to the high court. >> for centuries there wasn't a single woman on our nation's highest court. for the first time in our history there will be three women when elena kagan takes her seat. dressed up like cops and committing robbery. police are searching for a group of men responsible for a brazen home invasion.

it happened last night before midnight in pleasant hills close to i-680. three suspects walked into an open balcony door and ordered everyone to the floor, even shocking people with stun guns, they got away with electronics, including a big screen tv. investigators believe the suspects knew the victims or at least the layout, because they were in and out in three minutes. antioch police released a fright thing surveillance video of a robber holding a rifle in a bank yesterday. it happened on lone tree way just after noon. the three masked men brandished a handgun and a stun gun too. they were seen leaving in a gray newer model honda civic with a spoiler and license plate. anyone with information should call the antioch police department. at the end of summer in sight, the airlines are trying to coax reluctant vacationers into the skies with cheaper airfares, to take advantage of them, you'll have to be ready to fly on a tuesday or wednesday.

fall out there. temperatures about 10 to 15 degrees below average here for the bay area, santa rosa with a high today only in the mid-70s, san francisco in the upper 50s, livermore, the mid-70s in san jose, once again, 15 degrees off the mark in our october cooling. as we lookight now, we're seeing these cool temperatures remaining from heyward to oakland with mid-60s, 62 in san mateo, 4 in sunnyvale, and 62 in san jose. it's a big misnomer this time of year, we're used to having the fog, san francisco should be in the upper 60s, and still a lot of low 70s in the peninsula, that is not happening. we'll see this mild trend continue into friday with temperatures 10 degrees below ht average, summer continues to stay away in the seven-day forecast. there's the fog showing up on our snapshot from space and the visible satellite loop. c upce up at about

2,000 feet. take a look at where i have this arrow directed here, this is horning toward another weak system in the upper atmosphere, it's a trend we're seeing with the jet stream. we're continuing to drag down cooler air aloft hoping to keep the entire northwest below average. that combines in with the fog and keeps us mild for this time of the year. we'll look at more 70s returning friday, and for saturday summer stays away. 6:00 a.m. tomorrow morning, we're talking about low 50s across the bay area, and by 11:00 a.m. mostly sunny and conditions in the upper 60s for our mild weather. as for tomorrow, we'll expect 80 in morgan hills, that will be a stretch as we see the fog and that cooler air aloft combining in again. 73 in dublin, 77 in livermore, 60s to near 70s for the peninsula. 70 at redwood city, 63 in richmond, 77 in orinda, 74 in
